BULLETIN BOARD USER AGREEMENT

MISSION STATEMENT
Welcome to the American Buddha Online Library Bulletin Board! This is a Bulletin Board that is designed to discuss scholarly, political, social and creative topics in a positive atmosphere. The American Buddha Online Library Bulletin Board (“ABOL-BB”) is a moderated Bulletin Board, and accordingly, please read the terms of service below, as they lay down the ground rules for being a member of this online community.

PRIVACY PROTECTIONS AND ANTI-TROLL PROVISIONS
In order to protect your privacy we have a strong policy of protecting personal information from being invaded by any third parties that we call to your attention in paragraph 2. In order to prevent ABOL-BB from suffering from cynical disinformation attacks that have afflicted many websites and blogs that have come under attack from paid trolls, we have a very serious deterrent that we call your attention to in paragraph 14. If you intend to interfere with the smooth operation of ABOL-BB, you are duly warned not to request ABOL-BB membership.

TERMS OF SERVICE
This agreement is made between the operator of the NaderLibrary.com Bulletin Board (“Sponsor”) and each individual member of ABOL-BB (“You”).

    1.) Sponsor requires You to use your true name as a user name on ABOL-BB. You agree that You will submit true and accurate member information on Your member information form.
    2.) Sponsor agrees that Your personal information will be kept private and not disclosed to any person or individual in response to any third party request except and until an actual court order by a court of competent jurisdiction is issued directing Sponsor to produce such data after having provided due notice and an opportunity to be heard in full compliance with the First and Fourteenth Amendments of the United States Constitution as interpreted by the Ninth Circuit Court of Appeals and or the United States Supreme Court.
    3.) You agree that ABOL-BB may send You email at Your email address for purposes directly connected with the operation of ABOL-BB.
    4.) Sponsor provides You with access to the ABOL-BB, including the means of posting your expressions in words and images.
    5.) You may request that the Sponsor create new forums or threads by sending a Private Message to the Administrator.
    6.) You may post any text, images, or videos that will further the positive discussions at ABOL-BB, so long as they are not false and defamatory of any person or entity, derisive or insulting to other ABOL-BB members, or violative of an individual's privacy.
    7.) You agree that if you post copyrighted material, that it is for the Fair Use Purposes set forth at 17 U.S.C. Sections 107 and 108, that is, only for the purpose of discussion, scholarship and study, and not as a means to infringe the copyrights of others.
    8.) You agree that you will not misrepresent copyrighted material as your own, nor will you plagiarize or fail to provide due attribution to authors and artists. Where possible, you will post a link to the original source of any copyrighted material so that viewers can quickly discover the original source of the material.
    9.) You will maintain an attitude of civility and mutual respect for other ABOL-BB members, and will refrain from hurling epithets, making derisive comments about other ABOL-BB members, or engaging in troll-behavior that has a tendency to degrade the quality of the dialogue.
    10.) You agree that if, in the sole discretion of Sponsor, Your posts have violated the requirements of this agreement, that they may be deleted or made non-visible on ABOL-BB, and waive any claim that You might have under any theory of law with regard to such deletion or removal.
    11.) You agree that if You misuse Your ABOL-BB membership, it may be terminated.
    12.) You agree that if You misrepresent Your personal information, either by entering false information on the membership form, or by agreeing falsely to the representations regarding Your identity, employment, intents or purposes set forth herein, that Your ABOL-BB membership may be terminated.
    13.) You agree that this agreement has no pecuniary value to You, and waive any claims for financial damages against Sponsor. You agree that Sponsor shall not be held responsible for any statements or disclosures made about You on the ABOL-BB, and hereby expressly waive any and all claims against Sponsor and other ABOL-BB members in any court in any jurisdiction, domestic or foreign, under any theory of action, whether statutory, at common law, in tort or contract. You further agree that a copy of this agreement may be pleaded as a full defense to any action.
    14.) You understand that Your Internet Protocol address may be logged to confirm Your compliance with the terms of this paragraph. You affirm that you are not: (a) a paid or unpaid political consultant, lobbyist, think-tank worker, speechwriter, or professional troll for any political party; (b) a researcher or information worker of any intelligence-gathering agency or contractor of the United States government or foreign nation; or (c) other person whose purpose in posting on ABOL-BB is anything other than good-faith discussion. Regardless of Your employment or affiliation, You will not attempt to penetrate or circumvent the security of ABOL-BB or its information processing system in any way, either to obtain information concerning other members, to interfere with the operation of ABOL-BB, to alter or delete posts or other data at ABOL-BB, to engage in automated posting of commercial messages, to impair the efficient functioning of ABOL-BB, or in any way to circumvent the proper and natural operation of ABOL-BB. You agree that by operating ABOL-BB, Sponsor is engaged in interstate commerce and incurs substantial expense by operating this website. Violation of the provisions of this paragraph only may result in an action against You for fraud in connection with an access device under 18 U.S.C. Sec. 1030(g). Sponsor may file such an action and any related claims in the United States District Court for the Northern District of California in Oakland, California, and You hereby agree to the jurisdiction and venue in said district solely for purposes of such an action.
    15.) Except with respect to a claim by Sponsor made pursuant to paragraph 14 above, You agree that nothing posted on ABOL-BB by You or any other ABOL-BB member or Sponsor may ever be submitted to any court or adjudicative body as evidence of any sort.
    16.) You agree to the terms of this agreement electronically, and Your agreement is as binding as a signature on paper, and therefore waive any objection to its enforceability based thereon.
